Hisab App Terms & Conditions

1. Acceptance of terms

By creating an account, logging in, or using the mobile application "Hisab - Finance Manager"(the "App"), you agree to be bound by these Terms and Conditions ("Terms") and our Hisab App Privacy Policy.

If you do not agree to these Terms, you must not install, access, or use the App.

2. Provider and governing law

The App is provided by Divtechnosoft ("we", "us" or "our"), based in Gujarat, India. These Terms are governed by and construed in accordance with the laws of India, without regard to conflict‑of‑law principles.

You agree that any dispute relating to the App or these Terms will be subject to the exclusive jurisdiction of the competent courts located in Gujarat, India, to the extent permitted by applicable law.

3. Accounts and login

To use the App with cloud backup and sync, you need an account. You can register or log in using:

• Google login
• Facebook login
• Apple login
• Email and password login

You must provide accurate information and keep your login credentials secure. You are responsible for all activity that occurs under your account. If you believe your account has been compromised, you should change your password and contact us as soon as possible.

4. Purpose of the App and data responsibility

The App is designed to help you track income and expense entries and related financial notes. It is a personal finance management tool and does not provide financial, tax, or legal advice.

You are solely responsible for:

• The accuracy, completeness, and legality of the data you enter into the App.
• Reviewing and verifying any reports or summaries generated by the App before relying on them.
• Maintaining your own independent records and backups as needed for accounting, tax, or regulatory purposes.

We do not guarantee that the App's calculations, categorisation or summaries are error‑free, nor that they are suitable for filing taxes or meeting any regulatory requirements.

5. License and intellectual property

Subject to your compliance with these Terms, we grant you a limited, non‑exclusive, non‑transferable, revocable license to install and use the App on devices that you own or control, solely for your personal, non‑commercial use.

All intellectual property rights in and to the App (including but not limited to the software, design, graphics, text, and content) are owned by or licensed to Divtechnosoft and are protected by applicable intellectual property laws. No rights are granted to you except as expressly stated in these Terms.

6. Acceptable use

You agree that you will not, and will not attempt to:

• Use the App for any unlawful, harmful, or fraudulent purpose.
• Decompile, reverse engineer, disassemble, modify, or create derivative works of the App, except where such restrictions are prohibited by applicable law.
• Interfere with or disrupt the operation of the App, servers, or networks.
• Introduce viruses, malware, or other harmful code.
• Attempt to gain unauthorized access to other users' data or to restricted areas of our systems.

7. Data storage, backup, and loss

The App stores data both on your device and on a managed cloud backend hosted in the South Asia (Mumbai) region. While we take reasonable steps to safeguard your data and keep the service available, no system is completely fail‑safe.

To the maximum extent permitted by law, we are not liable for any loss of data or inability to access data arising from device loss, damage, uninstallation of the App, account deletion, connectivity issues, third‑party service outages, or other events beyond our reasonable control. You should maintain your own backups of important information where necessary.

8. Advertising and third‑party services

The App may show advertisements delivered by third‑party providers such as Google AdMob. Even if ads are not yet active in your version of the App, you acknowledge and agree that advertising may be enabled in the future.

We are not responsible for the content of any third‑party advertisements or websites that you may access via such ads. Your use of third‑party services is governed by their own terms and privacy policies.

9. Privacy

Your use of the App is also governed by our Hisab App Privacy Policy, which explains how your data is collected, stored, and used. You can view it here:

10. Disclaimers

The App is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, we disclaim all warranties, representations, and conditions of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non‑infringement.

We do not warrant that the App will be uninterrupted, secure, or error‑free, or that any defects will be corrected. You use the App at your own risk.

11. Limitation of liability

To the maximum extent permitted by applicable law, Divtechnosoft and its directors, employees, and affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, revenues, or data, arising out of or in connection with your use of, or inability to use, the App, including any use of your data in accordance with these Terms and the Hisab App Privacy Policy, even if we have been advised of the possibility of such damages.

To the extent that we may be liable under applicable law, our total aggregate liability in connection with the App and these Terms will in no event exceed the amount (if any) you paid to us to use the App (which is typically free to download and use, excluding any third‑party charges such as mobile data fees).

12. Suspension and termination

We may, at any time and without prior notice, suspend or terminate your access to the App, or any part of it, if we reasonably believe that you have violated these Terms, misused the App, or if we decide to discontinue the App or any of its features.

Upon termination, the rights and licenses granted to you under these Terms will immediately cease, and you must stop all use of the App and remove it from your devices. Certain provisions of these Terms that by their nature should survive termination (such as limitations of liability and disclaimers) will continue to apply.

13. Changes to the App and these Terms

We reserve the right to modify, update, or discontinue the App (or any part of it) at any time, with or without notice.

We may also update these Terms from time to time. When we do, we will change the "Last updated" date where these Terms are presented in the App or on our website. Your continued use of the App after changes become effective will constitute your acceptance of the updated Terms.
