NutriSnap App Terms & Conditions

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Divtechnosoft ("Company," "we," or "our"), governing your access to and use of the NutriSnap mobile application, website, and related services (collectively, the "Service").

By accessing, downloading, installing, or using the Service, you expressly acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately cease all use of the Service and uninstall the application.

2. Eligibility

By using the Service, you represent and warrant that:

• You are at least 13 years of age.
• If you are under 18, you have obtained the consent of your parent or legal guardian to use the Service.
• You have the legal capacity to enter into a binding contract (or your parent/guardian has done so on your behalf).
• Your use of the Service does not violate any applicable law or regulation.

3. Subscription and Billing

3.1 Pro Subscription

NutriSnap offers a premium "Pro" subscription that unlocks additional features, including "Unlimited" food scans, detailed nutritional analysis, and personalized recommendations.

3.2 Fees and Payments

Subscription fees are billed in advance on a recurring basis (monthly or annually) through your Apple App Store or Google Play Store account. You agree to pay all fees associated with your selected subscription plan.

3.3 Cancellation

You may cancel your subscription at any time through your device's account settings. Cancellation will take effect at the end of the current billing period. No refunds will be provided for partial billing periods.

4. Fair Use Policy

To ensure the stability, availability, and quality of the Service for all users, we enforce a Fair Use Policy regarding "Unlimited" features.

4.1 Definition of Fair Use

"Unlimited" scans are intended solely for personal, non-commercial use by a single individual for legitimate dietary tracking purposes.

4.2 Usage Limits

We define "Fair Use" as a volume of usage that does not exceed 600 scans per month (approximately 20 scans per day). This limit is calculated to be significantly higher than the average user's needs (typically 3-5 meals per day).

4.3 Excessive Use and Abuse

Usage that consistently exceeds the Fair Use limit, or exhibits patterns indicative of automated, bot-driven, or non-personal use, is considered a violation of these Terms. We reserve the right, at our sole discretion, to:

• Throttle or limit the speed of your service.
• Suspend your access to the Service.
• Terminate your account without refund.

5. User Conduct and Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Illegal Use: Using the Service for any unlawful purpose or in violation of any local, state, national, or international law.
• Account Sharing: Sharing your account credentials, subscription, or access with any third party.
• Automated Access: Using bots, spiders, scrapers, or other automated means to access, query, or collect data from the Service.
• Reverse Engineering: Attempting to decompile, disassemble, reverse engineer, or otherwise attempt to derive the source code of the Service.
• Harmful Content: Uploading or transmitting viruses, malware, or any other malicious code.
• Harassment: Harassing, threatening, or defaming other users or Company personnel.

6. User Content

6.1 Ownership

You retain ownership of any photos, data, or other content you upload to the Service ("User Content").

6.2 License to Company

By uploading User Content, you grant Divtechnosoft a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, and display your User Content solely for the purpose of providing, improving, and analyzing the Service (e.g., training our AI models to better recognize food).

6.3 Responsibility

You are solely responsible for your User Content. You represent and warrant that you own or have the necessary rights to upload such content and that it does not violate the rights of any third party.

7. Intellectual Property Rights

The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Divtechnosoft, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

8. Medical Disclaimer

THE SERVICE DOES NOT PROVIDE MEDICAL ADVICE.

The nutritional information, analysis, and recommendations provided by NutriSnap are for informational purposes only and are generated by Artificial Intelligence. They should not be considered medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition or dietary changes. Reliance on any information provided by the Service is solely at your own risk.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. DIVTECHNOSOFT DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DIVTECHNOSOFT, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE;
• (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE;
• (C) ANY CONTENT OBTAINED FROM THE SERVICE; OR
• (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

11. Indemnification

You agree to defend, indemnify, and hold harmless Divtechnosoft and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by arbitration in Gujarat, India.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
